The Prospective Marriage (subclass 300) Visa, commonly referred to as the Fiancé Visa, is a temporary visa, which allows you to travel to Australia in order to marry your prospective spouse. You must be outside of Australia in order to apply for this visa.
The Prospective Marriage visa permits a stay of between 9 and 15 months. Once married, if you and your spouse decide to settle down in Australia, you are then able to apply for an onshore Partner (subclass 820/801) Visa.
To be eligible for this visa, you must intend to marry an Australian citizen or permanent resident, or an eligible New Zealand citizen, who acts as the ‘sponsor’ for your application. You and your partner must have met in person, be known to one another personally, and you must both be over the age of 18. You must also have a genuine intention to live together as spouses once you are married, and you must provide proof of these plans to the Department.
You will need to intend to marry your partner within 9 months of your visa being granted, and you will need to provide evidence of this. This evidence should demonstrate the arrangements that you and your partner have made for your wedding to occur once you have arrived.
The evidence required for this visa subclass is very specific, and includes a letter from the authorised marriage celebrant who will be conducting the ceremony, a Notice of Intention to Marry, and other comprehensive evidence of your relationship and intentions as a married couple moving forward. The Department will need to assess the financial and social aspects of your relationship, the nature of your household and your commitment to one another in future, and will require comprehensive evidence across each of these points.
You and your sponsor must also satisfy a number of additional considerations, which can include assessments as to your health and character. Supporting evidence, such as police certificates, will be required in addition to the above.
