The Partner (subclass 820/801) Visa allows the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live and work in Australia.
Generally, you will need to either be married to your partner or, at the least, be able to show that you and your partner have lived together in a de facto relationship for at least 12 months before applying for the Onshore Partner Visa (subclass 820 and 801) (with some exceptions).
The application is undertaken in two stages: first, the subclass 820 temporary Partner visa, following which you can be considered for Australian permanent residency through the subclass 801 permanent Partner Visa (usually two years after the application was initially lodged). The Partner (subclass 820/801) Visa is also comprised of two main components: the main application, and the sponsorship application (undertaken by your partner).
In order to apply for a Partner (subclass 820/801) Visa, you must be in a genuine relationship with your de facto partner or spouse, who must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen.
This visa subclass requires substantial evidence to show all aspects of your relationship, including your finances, social life, household and shared commitment to one another. Your evidence must prove that you are mutually committed to the exclusion of all others, you are in a genuine and continuing relationship, you live together (or live separately on a temporary basis only) and are not related by family.
You and your sponsor must also satisfy a number of additional considerations, which can include assessments as to your health and character.
